1. AGREEMENT
Agreement on the basis these terms and conditions arise upon the fulfilment of all the following: receipt by Wildlife Safaris Scotland any information requested and the accompanied payment specified; clearance of the payment in to The Wildlife Safaris Scotland Company bank account; acceptance by Wildlife Safaris Scotland in writing.
Wildlife Safaris Scotland reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking, in such circumstances no agreement arises and Wildlife Safaris Scotland will return any payment accompanying the booking.
The agreement is between Wildlife Safaris Scotland and the client(s) and is the sole agreement between these two parties. No variation of these terms and conditions shall be applicable unless agreed in writing by Wildlife Safaris Scotland at the time of booking.
The agreement is governed by Scottish Law.
2. BOOKING AND PAYMENT
Once you have made the payment for the course or experience , we will send you confirmation.
At the moment we only accept full payment for our courses and experiences.
Our payment method is bank transfer to the Wildlife Safaris Scotland Ltd company account, when the payment has been cleared, we will confirm that the course or experience booked has been reserved.
3. AMENDENTS TO BOOKING
Wildlife Safaris Scotland appreciates that final numbers will not always be known at the time of booking and will endeavour to accommodate amendments to bookings, but cannot guarantee that it will be possible. Wildlife Safaris Scotland can only accept written requests (mail or email) for amendments, requests telephoned in initially must be followed up immediately with confirmation email.
Wildlife Safaris Scotland have the right to charge an amendment fee of £10.00.
4. CANCELLATION BY CLIENT(S)
If booking is cancelled by the client(s) (for any reason) the following cancellation charge will arise:
5. PRICES
Whilst every effort is made to limit prices to those given in the booking, Wildlife Safaris Scotland reserves the right to alter prices should its costs in hosting a course or experience increase for reasons beyond its reasonable control (including without limitation, the cost of labour, transport and materials).
If a price is altered the client(s) will be notified as soon as reasonably possible and the balance will need to be paid and cleared before the course or experience date, which is under the same terms as was the original price.
In the event of the price being thus increased by 10% or more the client may opt to cancel the booking and will then be entitled to a refund of all monies paid.
6. COURSE DATE CHANGES
Should a client wish to change the dates of there course or experience, where there is a place available, an administration fee of £20.00 will be charged to transfer.
7. VARIATION OF A COURSE OR EXPERIENCE BY WILDLIFE SAFARIS SCOTLAND
Wildlife Safaris Scotland courses or experiences are, by its very nature, exposed to natural variables, including the weather. Whilst every reasonable effort is made to deal with (indeed to learn from) such contingencies there may be occasions when Wildlife Safaris Scotland, through no fault of its own, is forced to vary or modify a course itinerary at short or decides to do so in order to take advantage of natural circumstances. The client acknowledges that information about courses and experiences provided by Wildlife Safaris Scotland is given in the best of faith but that because of the variability of nature it may be reasonable to alter or modify a course or experience and that in such circumstances it is not reasonable for Wildlife Safaris Scotland to be liable for any losses consequential on such a change and that Wildlife Safaris Scotland liability is limited accordingly.
8. THE CONDUCT OF A COURSE OR EXPERIENCE
The client acknowledges that during Wildlife Safaris Scotland courses or experiences he/she is required to submit to the reasonable instructions and leadership of Wildlife Safaris Scotland. The client acknowledges that persons attending a Wildlife Safaris Scotland courses or experiences are entitled to expect high standard of conduct and regard for personal wellbeing on the part of all clients.
For this reason, the client accepts that Wildlife Safaris Scotland may, in absolute discretion and without the need to give reasons, arrange for him/her to be removed from the course or experience, if necessary, against his/her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of the course or experience. In such circumstances the client will no be entitled to a refund of monies and Wildlife Safaris Scotland will not be liable for any losses so resulting. The client client will on demand reimburse Wildlife Safaris Scotland its reasonable costs of effecting his/her removal.
9. LIABILITY
Wildlife Safaris Scotland courses and experiences take place in the open countryside and are by their very nature not absolutely free from hazard. Wildlife Safaris Scotland makes every effort to minimise risk to clients and instructs clients in the safe negotiation of such risk as may remain. Consequently, the client acknowledges that there are circumstances in which an accident could befall a client without Wildlife Safaris Scotland being at fault and accepts that to that extent he/she is taking part in a course or experience run by Wildlife Safaris Scotland.
Wildlife Safaris Scotland only accepts liability for physical injury to a client that is shown to result from negligence on the part of Wildlife Safaris Scotland.
The client acknowledges that other loss, damage and expense (including without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and the harm caused other than by negligence of Wildlife Safaris Scotland) however arising is not the responsibility of Wildlife Safaris Scotland is hereby limited.
10. COMPLAINTS
In the unlikely event that a client has cause to complain about a course or experience run by Wildlife Safaris Scotland complaint should be made to a representative of Wildlife Safaris Scotland during the event, in order that corrective action can, if necessary, be take. The client acknowledges that it is unreasonable to take no action during a course or experience but to complain later. However, should a problem not be resolved, complaint should be made in writing within 28 days.
To the extent permitted by law Wildlife Safaris Scotland will not be liable in respect of claims first intimated by law Wildlife Safaris Scotland will not be liable in respect of claims first intimated later than 28 days from the close of the revelant course or experience.
11. TRAVEL DOCUMENTS
The client is solely responsible, where necessary, for ensuring that he/she has all necessary valid travel documents and travel insurance.
12. CONSENT FORM
Does not apply at this time.
The client acknowledges that they must sign and complete a consent form, which must be returned to Wildlife Safaris Scotland at least two weeks prior to the commencement of the client's course or experience. The consent form will be sent to the the client when they make final payment for their course or experience. The client will be reminded to complete and return the form when they have paid any remaining payment.
13. SUBSEQUENT INSTRUCTIONS BY CLIENT(S)
Although, as stipulated above, all Wildlife Safaris Scotland courses and experiences are taught and run by highly experienced and capable military leaders, it is not intended that any instruction provided to any client(s) while on a course or experience will in any way qualify that those client(s) to instruct any third party and no warranty is made to that effect. Wildlife Safaris Scotland hereby excludes any liability it might have to any third in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) om the basis of having attended any Wildlife Safaris Scotland courses or experiences.
Wildlife Safaris Scotland unless required by law, neither party shall disclose the other's confidential information to any person or entity. Neither party shall (except with the prior written consent of the other party) directly or indirectly solicit or entice away (or attempt to solicit or entice away) from the employment of the other party any person employed or engaged by such other party for a period of 12 months after the most recent course or experience departure date, other than by means of a national advertising campaign open to all corners and not specifically targeted at any of the staff of the other party. Should a client solicit a member of Wildlife Safaris Scotland staff in this period, it reserves the right to charge a fee of either 50% of the individuals annual remuneration or 50% of the total course fees for the calendar year prior to the member of staff's departure from employment of Wildlife Safaris Scotland Ltd.
14. CHANGES TO THIS AGREEMENT
Wildlife Safaris Scotland reserves the right to update the Terms & Conditions at anytime, without notice.
